Appeals Court Stops Re-selling of Software

The three judge 9th Circuit Appeals Court panel ruling on Friday circumvents a 1908 US Supreme Court ruling on the so-called "first sale doctrine". The 1908 ruling specifically said copyright holders cannot prevent a buyer from reselling or renting a product after an initial sale, as long as additional copies aren't made. This is the legal principle that allows used book and music stores to operate, as well as DVD subscription services such as Netflix.

A different sites review of the decision mentioned that it wouldn't take much for book and other printed material publishers to insert a "contract" into their publications similar to that of software. (That the purchaser is only "renting" it or purchasing a license to "use" the material...not to own it. And that it must be destroyed  or returned rather than resold.)

It's a wonder they don't slap something like that on cars, houses...all manufactured items. Wouldn't that stimulate the economy!!

I sure hope that one doesn't stick.  DVDs would be the first thing to go under it.
